ESSAE Submits Memorandum of Support for NYS Senate Regulatory Reform Package

ESSAE recently submitted a Memorandum of Support for the New York State Senate's Regulatory Reform Package, which is aimed at prospectively improving the regulatory framework in our state.

The Senate Regulatory Reform Package tackles important issues that affect everyone across the state—especially businesses, associations, and nonprofit organizations. Alarming practices such as the abuse of emergency rule making would be curtailed by this package.

ESSAE supports this initiative in regulatory reform as it would: 

  • Increase public input, i.e. longer comment periods, with stronger consideration given to comments and testimony, where elected leaders would learn of potential impact of regulations, etc. by the people who would be most impacted.
  • Establish a more thorough job impact statement, which was recently seen in response to the New York State Department of Labor’s Call-In Pay Regulations, which effects nonprofits, small business, and many organizations.
  • Curtail the abuse of emergency regulations which are adopted and put into effect overnight. In the last ten years more than 50% of all regulations adopted in New York State were put in place overnight without public input, notice, or information under the guise of emergency rule making. 

In addition, ESSAE supports SB244 (Ortt)/AB341 (Gunther), which has been included in the Senate's One House Budget Proposal as it is particularly important for nonprofits who receive state reimbursements for services they provide. This bill requires that the effective date of new regulations would not be established sooner than 90 days from adoption in order to give those nonprofits receiving reimbursements an ample amount of time to come into compliance, thus avoiding painful State claw backs.
